At SOFTWARE OF CHANGE, INC. (the “Company”, “we” or “us”), we use our Censeo Application and other internet-based tools for the following purpose:

BY ACCESSING OR SUBMITTING ANY INFORMATION THROUGH THE CENSEO APPLICATION, YOU ARE AGREEING TO THE TERMS OF THIS POLICY. YOU ARE PROHIBITED FROM ACCESSING OR USING THE CENSEO APPLICATION UNLESS YOU FULLY UNDERSTAND AND AGREE TO THIS POLICY AND ALL TERMS OF USE AVAILABLE FOR REVIEW ON THE CENSEO APPLICATION.

INFORMATION COLLECTED AND STORED

When you choose to create an account on the Censeo Application, we will collect and retain all personal identifying information submitted to us.

We will take all reasonable steps to protect the information submitted to us by users and we will take all reasonable steps to prevent the disclosure of any personal identifying information without the consent of users, unless otherwise set out in this Policy.

Personal identifying information may include, but is not limited to:

We will not use personal identifying information to contact you for any reason unrelated to your use of the Censeo Application or for commercial reasons unrelated to the business of the company. Credit card information, and other sensitive personal information required to process a credit decision, is not used for any other purposes by us or our financial services providers, and will not be retained any longer than necessary to provide your services, unless you request that we retain your credit card information to streamline your future purchases. We ask for certain information when a teacher, principal, school district/board or school administrator (collectively, “School”) registers for a Censeo Application account or corresponds with us online, which may include, but is not limited to, first and last name, email address, profile picture, user name and password, and any additional personal information you voluntarily provide in your Censeo Application profile, which could include, but is not limited to, your school name and location, what grade level and subject matter you teach, your position within the school, and the type of devices your students use (collectively, “School Data”). We may also collect School Data if the School sends us a message or responds to emails and surveys. Once the School has an account, we collect content and information provided by the School through the School’s use of the Service, which could include class rosters, parent contact information, assignments and classroom content, photos, images, video and any other content the teacher or Authorized Users posts to the Service. We use this information to operate, maintain and provide the features and functionality of the Service, to analyze and improve our Service offerings and functionality, and to communicate with our Schools and users.

Information About Parents and Guardians

We ask for certain Information when a parent or guardian (referred to herein as a “parent”) registers for a Censeo Application account, which may include information such as first and last name, email address, profile picture, user name and password, and any additional information the parent voluntarily provides, which could include, but is not limited to the name and location of your child’s school and what your relationship is with the child (parent, grandparent, guardian etc.). We may collect other personal information you provide to the Service, such as your email address and your child’s teacher’s name and email address if you request that we invite the teacher to check out our Service. We use this information to operate, maintain and provide the features and functionality of the Service, to analyze and improve our Service offerings and functionality, and to communicate with you.

Information About Students

Censeo Application provides the Service to Schools to facilitate School and parent engagement and create personalized learning portfolios. Through the provision of this Service to a School or parent, we may collect or have access to personal information about students (“Student Data”) that is provided by the School, parent or by the student. The type of information we collect will depend on how the School, parent or student uses the Service, but could include the student’s first and last name, email address, profile photo, class assignment data, and other classroom content. Some Schools set up the Service to permit a student to log into a student account. Only students who have been invited and authorized to use the Service by a School may register as a “student” for a Censeo Application account and use the Service.

We consider Student Data to be highly confidential and use this data solely to provide our Services to the School and to the parent, and in limited ways, for our internal purposes in accordance with our Terms of Service or specific agreements with Schools. Our collection, use, and disclosure of Student Data is governed by our Terms of Service and/or any other agreement with the School, in the U.S. by the provisions of the Family Educational Rights and Privacy Act (FERPA) and applicable state laws, and by other applicable Canadian, U.S. and international laws relating to the collection and use of personal information of students. If you have any questions about reviewing, modifying, or deleting the personal information of a student, please contact your educational institution directly.

ADDITIONAL DATA COLLECTED

To learn about your experience as a user and to make periodic improvements to the Censeo Application and our business, we may collect and retain certain information. We will automatically record information about your activity on the Censeo Application. This may include, but is not limited to, your internet protocol (IP) address, operating system, geolocation, locale preferences, identification numbers associated with your computers and mobile devices, your mobile carrier, date and time stamps associated with transaction, system configuration, metadata and other electronic interaction with the company Censeo Application.

COOKIES

To facilitate the collection of information and to enhance the experience of users of the Censeo Application, we use cookies which may be stored on users’ computers and/or devices so that we can recognize users when they return. You may set your browser to notify you when you receive a cookie or to not accept certain cookies. However, changing such settings may result in you not being able to use the Censeo Application, either in its entirety or certain features.

We may engage in “remarketing” activities using third-party services, which may include but are not limited to Google Ads, Google Analytics, Facebook and Stripe. By using the Censeo Application, you consent to allow us to provide information to third-party service parties who may present you with advertisements about the company after you visit the Censeo Application. We will provide third-party providers of remarketing services with the minimum amount of information required to facilitate remarketing, and in no circumstances provide personal identifying information to third-parties for the purpose of remarketing.

PERMITTED USES OF DATA

We use data collected from the Censeo Application for various purposes, including, without limitation, to: provide the Censeo Application to you and accompanying customer support; notify you about update and changes to the Censeo Application; prevent and address technical issues with the Censeo Application; monitor usage of the Censeo Application.

Without restriction, we may use any information you submit through the Censeo Application for any purpose we deem appropriate so long as it is anonymous and stripped of any and all personal identifying information.

We may use the data collected from the Censeo Application, devices, browsers, and any other sources, for its own purposes, both related to and unrelated to improving the Censeo Application.

We will take all reasonable steps to ensure your personal information is accessible, amended and/or deleted in a reasonable time after receiving that request. Deleting such information may require us to terminate any account you may have created in its entirety and prevent you from using the Censeo Application. We make no guarantees as the removal of your personal information from other Censeo Applications, affiliates, or other public or private sources that may have accessed that information while your account was active.

So long as your account remains active, we will preserve your personal information in accordance with the Policy.

You may decline to share certain personal information with us, in which case you may not be able to use the Censeo Application either in its entirety or certain features.

If you have not accessed your account for a total of 2 years, we may terminate your account, without notice, along with any personal information retained by us.

When deleting your information, whether by request or due to inactivity, we will use standard electronic means to remove your personal information from our files.

We will also retain any and all information that we are required to retain under any applicable laws for the full duration of time required under those laws.

To safeguard your privacy and security, we will verify your identity through various means, such as by requiring a password and user ID, before granting access to your data.

SECURITY BREACHES

In the event the personal information of a user is disclosed as the result of any breach of security of the Censeo Application or its servers, regardless of who is at fault, we will take all reasonable steps to advise all known affected users within 3 business days of learning of the breach.

THIRD-PARTY APPLICATIONS

To provide an enhanced experience to users, including to track conversions and analytics, we may engage services and features controlled by third-parties. We cannot control or dictate how any third-party application you use in conjunction with the Censeo Application, now or at any point in the future, will treat any personal information you transmit through their servers when using the Censeo Application. We advise you to contact these parties directly to review their privacy policies.

Without limitation, the company uses or may use the following third-party applications and services in conjunction with the Censeo Application:

Google analytics, AdWords, Facebook, SMS and Stripe.

By using any of these third-party applications to interact with the Censeo Application, we will not have access to your login credentials, username, password, payment information, or any information you may provide directly to these third-party applications.

USE OF APPLICATION BY MINORS

The Censeo Application is not intended to be accessed by persons under the age of 18. The company does not engage in any marketing efforts aimed at children or minors.

Persons under the age of 18 are prohibited from using the Censeo Application in any manner or providing any information to company. In the event company is providing any information, including personal identifying information, relating to a minor, that information will be immediately deleted without notice.

YOU MUST BE EIGHTEEN (18) YEARS OR OLDER TO ACCESS THE COMPANY'S CENSEO APPLICATION. IF YOU ARE UNDER EIGHTEEN YEARS OF AGE, YOU ARE NOT PERMITTED TO ACCESS THE COMPANY'S WEB SITE FOR ANY REASON. DUE TO THE AGE RESTRICTIONS FOR USE OF THAT CENSEO APPLICATION, NO INFORMATION OBTAINED BY THAT CENSEO APPLICATION FALLS WITHIN THE CHILDREN'S ONLINE PRIVACY PROTECTION ACT OF 1998 AND IS NOT MONITORED AS DOING SO.

Protecting children's privacy is especially important to us. We recognize that parents, guardians, or other adults often purchase our products for family use, including use by minors. We do not knowingly collect personal information from children under 13 for marketing purposes, but because some information is collected electronically, it can appear to be the personal information of the Company purchaser of the product, and will be treated as such by this privacy policy. If a child under 13 submits personal information to the Company and we learn that that personal information is the information of a child under 13, we will attempt to delete the information as soon as possible. It is our policy to comply with the Children's Online Privacy Protection Act of 1998 and all other applicable laws. Therefore we restrict our web site to persons 18 years or older.

USER REFERRAL SERVICE

If you choose to provide us with the names and email address of individuals that you feel would be interested in learning more about our service, we may send a preliminary email to each address provided to us, inviting the contact to visit our Censeo Application. This Policy may be updated and amended from time to time. We reserve the right to change this Policy at any time, and any amended policy is effective upon its posting on the Censeo Application. We will make all reasonable efforts to communicate any changes to this policy that we, in our sole discretion deem material. Any changes to this Policy deemed material will, as soon as reasonably possible, be transmitted to users via email or notifications on the Censeo Application. YOUR CONTINUED USE OF THE CENSEO APPLICATION WILL BE DEEMED ACCEPTANCE OF ANY AMENDED POLICY.

SOFTWARE OF CHANGE, INC. does not control those sites nor their privacy practices which may differ from Company’s practices and policies. Any personal data you choose to provide to or that is collected by such third parties is not in any way covered by the Company’s Privacy Policy.
